Your Legal Powers You have the legal right to confiscate fake ID documents as part of your role in preventing crime (fraud) and protecting the venue from committing offences under the Licensing Act 2003. However, proper procedure must be followed to avoid potential legal issues.

Legal Basis

Using a fake ID is an offence under:

• Fraud Act 2006 (Section 1 & 2) - fraud by false representation (indictable offence)
• Identity Documents Act 2010 - possession of false identity documents with intent (indictable offence)

By confiscating fake IDs, you are preventing crime under Section 3 of the Criminal Law Act 1967 and protecting the venue from prosecution for serving alcohol to minors or allowing underage entry.

Identifying Fake IDs

Before confiscating any ID, you must be reasonably certain it is fraudulent. Check for:

• Photo does not match the person presenting it
• Security features missing or incorrect (holograms, UV features, microprint)
• Incorrect fonts, spacing, or layout compared to genuine documents
• Dates that don't make sense (expiry before issue, person would be impossibly old/young)
• Poor quality printing or lamination
